Terms of Service

1. Acceptance of terms

By accessing or using any MarketingElite website, service, or product (“Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Services provided

MarketingElite provides web design, development, SEO, digital advertising, and the Restaurant Reservation System SaaS (“RRS”). Scope, deliverables, and pricing for project work are defined in individual Statements of Work (SOW) or proposals.

3. Client responsibilities

• Provide accurate information, brand assets, and timely approvals.
• Ensure you have rights to any content supplied to us.
• Make payments on agreed schedules.
• Provide DNS / hosting access as required to deliver the project.

4. Payment terms

Project work requires a deposit (typically 50%) before work begins. The balance is due on final delivery. SaaS subscriptions are billed monthly or annually in advance. All prices are in EUR exclusive of VAT where applicable.

5. Intellectual property

On final payment, clients receive full ownership of all custom-developed code, designs, and content created for their project. MarketingElite retains the right to display the work in our portfolio unless otherwise agreed. Third-party components retain their respective licences.

6. SaaS-specific terms (RRS)

• Subscription grants a non-exclusive, non-transferable licence to use the RRS.
• Operators are responsible for their own guest data compliance under GDPR as data controllers.
• Uptime target: 99.5% (monthly) for Pro and Multi-Venue plans.
• We may suspend access for non-payment after 7 days' notice.
• Data export is available at any time; data is deleted 30 days after subscription cancellation.

7. Limitation of liability

To the maximum extent permitted by law, MarketingElite's total liability for any claim arising from use of our services shall not exceed the fees paid by you in the 3 months preceding the claim. We are not liable for indirect, consequential, or loss-of-profit damages.

8. Termination

Either party may terminate a project engagement with 14 days' written notice. SaaS subscriptions may be cancelled at any time; the subscription remains active until the end of the billing period. No refunds are provided for partially used periods.

9. Governing law

These terms are governed by the laws of the Republic of Albania. Disputes shall be subject to the exclusive jurisdiction of the courts of Tirana, Albania, unless otherwise required by EU consumer protection law.
